ReviZi — Terms of Service

Welcome to ReviZi ("we," "us," "our"). These Terms of Service ("Terms") govern your access to and use of the ReviZi application, website, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.

ReviZi is operated in Australia and governed by Australian law. If you do not agree to these Terms, do not use the Service.


1. About the Service

ReviZi is an AI-powered study tool that helps students generate flashcards, quizzes, and summaries from uploaded documents. The Service uses artificial intelligence (including third-party AI models) to process your uploaded content and produce study materials.

ReviZi is a study aid only. It is not a substitute for textbooks, teachers, tutoring, official curriculum materials, or professional educational advice.


2. Eligibility and Accounts

2.1 Age Requirements

ReviZi is designed for Australian Years 11–12 students (typically aged 15–18) preparing for ATAR examinations.

  • If you are 16 or older, you may create an account and use the Service. If you are under 18, we recommend you review these Terms with a parent or guardian.
  • If you are under 16, you must have consent from a parent or legal guardian before creating an account or using the Service.
  • We may suspend or terminate accounts where we reasonably believe the user is under 16 and the required parental consent has not been obtained.

2.2 Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Accounts are for individual use only and may not be shared. You must notify us immediately of any unauthorised use.

2.3 Accurate Information

You agree to provide accurate, current, and complete information when creating your account and to update it as necessary.


3. Service Tiers and Payments

3.1 Free and Pro Tiers

ReviZi offers a free tier with limited features and a paid "Pro" tier with expanded capabilities. Tier limits (including generation quotas, file sizes, and card counts) are described within the app and may change from time to time.

3.2 Subscription Billing

Pro subscriptions are billed on a recurring basis (monthly or annually) as selected at the time of purchase. By subscribing, you authorise us to charge your payment method at the applicable rate until you cancel.

3.3 Cancellation and Refunds

You may cancel your Pro subscription at any time through your account settings or the platform through which you subscribed (e.g., Apple App Store, Google Play). Cancellation takes effect at the end of the current billing period. Except where required by Australian Consumer Law, subscription fees are non-refundable.

Australian Consumer Law rights: Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot be excluded, restricted, or modified by agreement.

3.4 Price Changes

We may change subscription pricing with at least 30 days' notice. Continued use after a price change constitutes acceptance of the new pricing.


4. AI-Generated Content — Accuracy Disclaimer

4.1 No Guarantee of Accuracy

ReviZi uses artificial intelligence to generate flashcards, quizzes, summaries, and other study materials. AI-generated content may contain errors, inaccuracies, omissions, outdated information, or misinterpretations of your source material. AI models can also produce "hallucinations" — content that appears plausible but is factually incorrect.

You acknowledge and agree that:

  • AI-generated study materials are provided "as is" and for supplementary study purposes only.
  • You must independently verify AI-generated content against your official textbooks, syllabus documents, teacher-provided materials, and other authoritative sources before relying on it for exams or assessments.
  • We do not guarantee any particular grade, exam result, or academic outcome from using the Service.

4.2 Curriculum Content Disclaimer

ReviZi may offer pre-built curriculum-aligned flashcard packs (e.g., for HSC, VCE, QCE, WACE, SACE, or TCE subjects). While we endeavour to align these with current syllabi:

  • Curriculum content is provided for study assistance only and may contain errors. It is not endorsed by, affiliated with, or approved by any state or territory education authority, examination board, or curriculum body (including but not limited to NESA, VCAA, QCAA, SCSA, SACE Board, or TASC).
  • Curricula change over time. We make reasonable efforts to keep content current but do not guarantee it reflects the latest syllabus updates.
  • Pre-built content should be used alongside — not as a replacement for — your school's official materials.

4.3 No Professional Advice

Nothing in the Service constitutes educational, academic, medical, legal, or other professional advice. For specific academic guidance, consult your teachers, school counsellors, or relevant professionals.

4.4 Academic Integrity

You are responsible for using ReviZi in compliance with your school's academic integrity policies and the rules of any examination authority (including NESA, VCAA, QCAA, SCSA, SACE Board, TASC, or equivalent). In particular:

  • ReviZi must not be used during supervised exams, assessments, or any setting where external tools are prohibited.
  • You must not submit AI-generated content as your own original work where your school or examination authority prohibits this.
  • ReviZi is not responsible for any academic misconduct findings, penalties, or disciplinary actions that may result from your use of the Service.

5. Your Content and Intellectual Property

5.1 Your Uploaded Content

You retain all ownership rights in the documents, images, and other materials you upload to ReviZi ("Your Content"). By uploading content, you grant us a limited, non-exclusive licence to process, store, and use Your Content solely for the purpose of providing the Service to you (e.g., extracting text, generating flashcards).

We do not use Your Content to train our own AI models. Third-party AI providers process Your Content solely for the purpose of providing the Service (i.e., generating study materials). Your uploaded documents are stored securely and associated only with your account.

5.2 AI-Generated Output

Flashcards, quizzes, summaries, and other materials generated by the Service from Your Content ("Generated Materials") are derivative of your inputs. You may use Generated Materials for your personal study purposes. We do not claim ownership of Generated Materials.

5.3 Your Responsibility for Uploaded Content

You are solely responsible for ensuring you have the legal right to upload and process any content you submit to ReviZi. You represent and warrant that:

  • You own the content, or have obtained the necessary permissions, licences, or rights from the copyright holder to upload and process it.
  • Your use of the Service does not infringe the intellectual property rights, privacy rights, or other rights of any third party.
  • You will not upload content that is illegal, harmful, defamatory, or violates any applicable law.

5.4 Copyrighted Materials (Textbooks, Notes, and Third-Party Content)

ReviZi processes content you upload to generate personalised study materials for your private use. However:

  • Uploading entire textbooks, workbooks, or other commercially published materials that you have not purchased or are not licensed to use may constitute copyright infringement under the Copyright Act 1968 (Cth).
  • The fair dealing provisions of Australian copyright law may permit limited use of copyrighted material for the purpose of research or study. However, ReviZi makes no determination as to whether your specific use qualifies as fair dealing. That responsibility rests with you.
  • You must not use ReviZi to reproduce, distribute, or share copyrighted materials beyond your own personal study use.

5.5 Sharing Generated Materials

If you share, export, or distribute Generated Materials that are derived from copyrighted source content (e.g., flashcards generated from a published textbook), you do so at your own risk and are responsible for ensuring such sharing complies with applicable copyright laws. ReviZi is not liable for any copyright claims arising from your distribution of Generated Materials.


6. Copyright Complaints and Takedown Procedure

6.1 Reporting Infringement

We respect intellectual property rights. If you believe that content available through the Service infringes your copyright, please contact us at:

Your notice should include:

  • Identification of the copyrighted work you believe has been infringed.
  • Identification of the material on the Service that you believe is infringing, with sufficient detail to allow us to locate it.
  • Your contact information (name, email address, and phone number).
  • A statement that you have a good-faith belief the use is not authorised by the copyright owner, its agent, or the law.
  • A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorised to act on the owner's behalf.

6.2 Our Right to Act

We may, at our sole discretion, remove content or suspend or terminate accounts where we reasonably suspect copyright infringement, even without receiving a formal complaint.

6.3 Repeat Infringers

We reserve the right to terminate or suspend the accounts of users who repeatedly upload infringing content.


7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law.
  • Upload content that is harmful, abusive, threatening, defamatory, obscene, or otherwise objectionable.
  • Attempt to reverse-engineer, decompile, or extract source code from the Service.
  • Use bots, scrapers, or automated tools to access the Service beyond normal usage.
  • Circumvent or manipulate tier limits, usage quotas, or other technical restrictions.
  • Share, resell, or sublicense your account or access to the Service.
  • Use the Service to generate content for commercial purposes (e.g., selling generated flashcard sets).

We reserve the right to suspend or terminate your account for violations of this section.


8. Service Availability and Interruptions

8.1 No Uptime Guarantee

ReviZi is provided on an "as available" basis. We do not guarantee uninterrupted, timely, secure, or error-free access to the Service.

The Service may be temporarily unavailable due to:

  • Scheduled or unscheduled maintenance.
  • Third-party service outages (including AI provider outages, cloud infrastructure issues, or payment processor downtime).
  • Technical failures, bugs, or unforeseen issues.
  • Events beyond our reasonable control (see Force Majeure below).

8.2 AI Service Dependency

The Service relies on third-party AI providers (such as OpenAI) to generate study materials. If these third-party services experience outages, rate limiting, degraded performance, or are discontinued, the flashcard generation and other AI features of ReviZi may be temporarily or permanently unavailable. We are not liable for interruptions caused by third-party AI providers.

8.3 Remedies for Service Interruptions

If the Service (specifically, AI-powered generation features available to Pro subscribers) is materially unavailable for a continuous period exceeding 7 days due to causes within our reasonable control, affected Pro subscribers may request a pro-rata credit for the period of unavailability by contacting us at [[email protected]]. This is your primary remedy for service interruptions, to the maximum extent permitted by law. This does not limit any rights you may have under Australian Consumer Law.

8.4 Data Preservation During Outages

We make reasonable efforts to preserve your uploaded content and generated flashcards during service interruptions. However, we do not guarantee against data loss and recommend you maintain your own backups of important materials.


9. Force Majeure

We are not liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, pandemics, government actions, internet or telecommunications failures, third-party service provider outages, cyberattacks, power failures, or labour disputes.


10. Limitation of Liability

10.1 Exclusion of Certain Damages

To the maximum extent permitted by law, ReviZi, its officers, directors, employees, agents, and affiliates will not be liable for any:

  • Indirect, incidental, special, consequential, or punitive damages.
  • Loss of profits, revenue, data, goodwill, or anticipated savings.
  • Damages arising from your reliance on AI-generated content, including but not limited to poor exam results, incorrect study materials, or academic consequences.
  • Damages arising from service interruptions, data loss, or unauthorised access to your account.
  • Damages arising from third-party AI provider outages or changes.

10.2 Liability Cap

To the maximum extent permitted by law, our total aggregate liability to you for all claims arising out of or in connection with these Terms or the Service (whether in contract, tort including negligence, or otherwise) is limited to the greater of:

  • The total fees you have paid to ReviZi in the 12 months immediately preceding the event giving rise to the claim; or
  • AUD $50.

10.3 Australian Consumer Law

Nothing in these Terms is intended to exclude, restrict, or modify any rights or remedies you may have under the Australian Consumer Law that cannot be excluded, restricted, or modified by agreement. Where our liability cannot be excluded, it is limited (to the extent permitted by law) to, at our election: re-supply of the relevant services, or payment of the cost of having the services re-supplied.

10.4 Acknowledgement

You acknowledge that:

  • The Service is a study tool and is not a guaranteed path to any academic result.
  • AI-generated content is inherently imperfect and should be verified independently.
  • Free tier users receive the Service at no cost, and paid users receive the Service at a price that reflects the limitations described in these Terms.
  • Free tier users acknowledge that availability, support, and functionality may be more limited than for paid users.

11. Indemnification

To the extent permitted by law, you agree to indemnify, defend, and hold harmless ReviZi and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to:

  • Your use of the Service.
  • Your breach of these Terms.
  • Your violation of any third-party rights, including intellectual property or privacy rights.
  • Content you upload to the Service.
  • Your distribution or sharing of Generated Materials.

This clause does not apply to the extent it would be unlawful under Australian Consumer Law.


12. Privacy

Your privacy is important to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which forms part of these Terms. Please review it carefully.


13. Modifications to the Service and Terms

13.1 Service Changes

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. This includes changes to features, tier limits, supported file formats, and AI capabilities.

13.2 Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notification at least 14 days before they take effect. Your continued use of the Service after such notice constitutes acceptance of the updated Terms. If you do not agree, you should stop using the Service and cancel any active subscription.


14. Termination

14.1 By You

You may stop using the Service at any time. You may delete your account through the app settings or by contacting us. Cancellation of a Pro subscription does not automatically delete your account.

14.2 By Us

We may suspend or terminate your account at any time if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or if required by law. We will make reasonable efforts to notify you before or promptly after any such action, unless doing so would compromise security or violate legal requirements.

14.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. We may retain or delete your data in accordance with our Privacy Policy and applicable law. Sections that by their nature should survive termination (including Limitation of Liability, Indemnification, and Governing Law) will survive.


15. Dispute Resolution

15.1 Informal Resolution

Before initiating any formal proceedings, you agree to contact us at [[email protected]] and attempt to resolve the dispute informally for at least 30 days.

15.2 Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Victoria, Australia. Any disputes that cannot be resolved informally are subject to the exclusive jurisdiction of the courts of Victoria, Australia.


16. General Provisions

16.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and ReviZi regarding the Service.

16.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16.3 No Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

16.4 Assignment

You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
